Article 2 - Definitions

Offer: The offer of Products via the Website or the Cashier.
Customer: Any natural or legal person who purchases a product or service from SKYMAX, places an order or reservation, or sends a request for a quotation, whether on their own behalf or on behalf of a third party. The term also includes any person acting in the name of or on behalf of a third party in these same contexts.
Visitor: Any natural person who accesses, in any capacity whatsoever, the facilities or activity areas operated by SKYMAX, including trampoline, playground, virtual reality areas, or any other present or future recreational area. In the case of a minor, the term "Visitor" also includes his/her parent, guardian or legal representative. The same individual may be both Customer and Visitor.
Group: Two or more Visitors visiting SKYMAX together.
Contract: Any agreement under which SKYMAX provides services or products.
Products: All access cards, reservations, subscriptions and other products offered by SKYMAX.
Entrance ticket: A ticket giving the visitor access for a specified period to one of the SKYMAX areas during opening hours.
Reservation: Act by which the Customer selects an activity, a time slot and places an order via the Site or at the Cashier.
Cashier: A physical point of sale or payment terminal in the Park.
Rules: The SKYMAX Park rules and regulations to which all visitors must adhere.

Article 3 - Scope and acceptance of the T&C

These General Terms and Conditions of Sale (T&C) constitute, unless otherwise agreed in writing, the law between the parties and govern all contractual relations between SKYMAX and the Customer, as well as access to the facilities by Visitors.
These GTC define the respective obligations of the parties for the provision of the service offered by SKYMAX and the use of the Web Site.
SKYMAX is free to make changes or additions to the GTC at any time. Updated versions apply as soon as they are published on the Site. All visitors must comply with the T&Cs.
Any user of the Website acknowledges and agrees to be bound by the rules of these T&Cs applicable to him/her and by our Privacy Policy, from the moment he/she browses the Website.
The GTC apply to any visit to a SKYMAX establishment and/or to all legal relations between SKYMAX and the visitor, including the contract and all offers and proposals from SKYMAX.
The fact that an individual or legal entity places an order on the Site or directly at the cash desk of one of our establishments implies full acceptance of these general terms and conditions of sale. They are accessible at all times on the Website as well as on site at the cash desk and will prevail, where applicable, over any other version and over the Customer's own general terms and conditions of purchase or others.

Article 4 - Services offered, offers and contracts 

SKYMAX offers several activities: trampoline (SKYJUMP), playground (SKYMINI), virtual reality, arcade (HOLOGATE VR) and other leisure activities to come.
SKYMAX also offers events: birthdays, school outings, corporate events, hen or stag parties.
Each activity is subject to specific conditions (age, size, accompaniment), indicated on the Site and when booking.
SKYMAX reserves the right to modify schedules or temporarily close activities for technical, safety or maintenance reasons, without possible compensation.

All communications sent by SKYMAX or information otherwise provided, such as opening hours and rates, are non-binding and subject to change.
SKYMAX accepts no responsibility for any errors in advertisements, offers, communications or information provided to visitors by any advertiser outside SKYMAX. The same applies to errors made by third parties in the sale or distribution of admission tickets.
The contract is established by the simple fact of the visitor's acceptance of SKYMAX's offer. In the case of an offer transmitted via the website, the contract is established when SKYMAX sends an e-mail confirmation.
An admission ticket may be purchased at the park ticket office or pre-booked via the website. A ticket for the SKYMINI or SKYJUMP area loses its validity simply by the expiry of the date and time stated on it.
Proposals, offers and draft contracts from SKYMAX are intended solely for the visitor who has requested them, due to their intuitu personae nature. No other person may claim any rights on the basis of these offers and drafts without SKYMAX's express written consent;
The description of services may change at any time without prior notice, at SKYMAX's sole discretion. The company also reserves the right to discontinue or modify the services offered at any time. 

Article 5 - Access to SKYMAX activities

5.1. General provisions
  • Access to any SKYMAX activity is exclusively reserved for people with a valid admission ticket, ordered via our online booking site or purchased at the park cash desk.

  • Visitors must comply with the internal rules and regulations as well as safety instructions posted or communicated by staff.

  • Parents, legal representatives or accompanying adults are responsible for any minors they accompany. They must adopt exemplary behavior and refrain from encouraging dangerous attitudes.

  • Management reserves the right to exclude any visitor who fails to comply with the rules, without refund.

  • Access is forbidden to anyone presenting themselves under the influence of alcohol, drugs or medication impairing alertness

5.2. Access to SKYMINI (Playground)
  • Age requirements: activity reserved for children aged 1 to 7.

  • Children must be under the active supervision of a parent or accompanying adult, present in the area.

  • Each admission ticket includes access for one accompanying adult. Any additional accompanying person must purchase a Buddy Pass.

  • Wearing SKYMAX non-slip socks is mandatory.

  • It is forbidden to bring personal toys or any dangerous object into the SKYMINI zone.

  • Capacity: between 40 and 100 people present simultaneously depending on the size of the park (surface area from 400 to 1,000 m²).

5.3. Access to SKYJUMP (Trampoline Park)
  • Age requirements: children aged 4 and 5 may only access the activity if accompanied by an adult, while children aged 6 and over may access unaccompanied.

  • Access to the SKYJUMP is conditional on wearing casual clothing and SKYMAX non-slip socks.

  • Capacity: between 65 and 170 people present simultaneously depending on the size of the park (surface area from 700 to 2,000 m²).

  • The activity is reserved for people in good physical and mental health. By purchasing a ticket, visitors declare that they are fit for the activity and have no medical contraindications (pregnancy, heart problems, injuries, contagious diseases, psychiatric disorders).

5.4. Access to HOLOGATE VR (Virtual Reality)
  • Age requirements: from 6 years of age, unless specifically indicated for certain games.

  • The wearing and correct use of the equipment provided (headset, controllers) is compulsory.

  • Activity reserved for people in good health and with no medical contraindications (epilepsy, balance disorders, heart problems).

  • Capacity: maximum 4 players play simultaneously per Hologate VR station.

5.5. Access to the Arcade Zone
  • Age requirements: 6 years and over. Children under 6 are allowed in the zone under adult supervision.

  • Some games may have age restrictions (mentioned on each machine).

  • Only SKYMAX tokens can be used in the coin-operated machines. Game tokens are non-refundable and non-exchangeable. The use of any other part or object is strictly forbidden and may result in the billing of repair or replacement costs for damaged equipment.

  • Each player must use a gaming seat or station individually. It is forbidden to simultaneously share a station intended for a single player. Games equipped with several seats, shuttlecocks or stations are naturally designed to accommodate several players, and each must occupy his or her own seat.

Article 6 - Visitor obligations

The visitor is obliged at all times to comply with these general conditions, the house rules, the safety instructionś, as well as the indications and instructions given by park employees and/or other third parties called upon by the park;
The visitor must be present in the relevant SKYMAX park fifteen (15) to  twenty (20) minutes before the start of the agreed activitý. The absence or too late arrival of the visitor or a group entitles SKYMAX to consider the contract as cancelled́, in accordance with these general terms and conditions. In such a case, the visitor or group has no right either to a refund or to an extension of the activitý or a later recovery;
Before the start of the activities, the visitor is obliged to acquaint himself with the safety instructionś, the infrastructures as well as the equipment made available to him;
If the visitor fails to comply with the safety instructions, breaches these general conditions and the internal regulations or fails to comply with the park's usual indications and instructions, he or she may be refused access to the park and/or asked to leave the park immediately by one of its attendants. SKYMAX will not be liable for any compensatioń generally whatsoever and will not be required to refund the amount paid by the visitor for his or her admission ticket.
If SKYMAX considers that the visitor, through his/her attitude or repeated non-compliance with regulations and other safety instructions, is detrimental to the safety of the park and its users, it reserves the right, without having to justify itself, to temporarily or permanently refuse him/her access to the park
It is strictly forbidden to consume alcohol, drugs or substances affecting alertness during the visit or before any activity.
It is forbidden for visitors to bring their own food, or beverages and consume them in SKYMAX buildings;
Pets are forbidden in the trampoline area of the SKYMAX park;
In the event of destruction, damage, removal, misappropriation or theft of objects by the visitor, SKYMAX reserves the right to exclude the visitor from the park and impose a temporary or permanent ban from one or all of its parks. SKYMAX also reserves the right to report violations of criminal law to the police. In all cases, it may claim damages for any prejudice suffered, whether material or resulting from loss of earnings.

Article 7 - Price

Prices for services are available on request, on the SKYMAX website and on social networks;
Prices communicated by SKYMAX are in euros (€) inclusive of all taxes;
The valid price is that communicated on the day of booking. SKYMAX reserves the right to increase or decrease the prices offered at any time and at its own discretion;
Prices are based on the VAT rates in force on the date the offer is submitted, and any subsequent change in these rates will be reflected in the prices;
Any discounts, promotions or price reductions granted by SKYMAX are specific to each visitor and each order. They are of a precarious nature and do not bind SKYMAX for other possible reservations, which may adapt them or waive their application at its sole discretion. 

Article 8 - Payment

The rates applied by SKYMAX are communicated to visitors on the website and displayed in the parks. They can only be opposed to SKYMAX by the visitor at the time of the order. Any variation prior or subsequent to the order cannot engage the responsibilitý of SKYMAX;
Payment for products or services offered by SKYMAX must be made before the visitor accesses the park;
Payment is made according to the methods indicated during the purchase process (online or at the cash desk).
The visitor must check the accuracy of the invoice or receipt and any change given directly at the time of payment;
In all cases where the parties have agreed a form of payment other than cash, payment of amounts due by the visitor to SKYMAX must take place within fourteen (14) days of the invoice date, to the bank account mentioned on the invoice and in all cases before the visitor's access to the park. No compensation, deduction or suspension may be made by the visitor;
Any invoice not paid by the due date shall automatically and without formal notice entail late payment interest calculated at the legal rate in force, as well as the payment of a fixed indemnity of 40 euros, without prejudice to other collection costs.

Article 9 - ORDERS & CONFIRMATIONS

Orders (admission tickets possibly combined with other SKYMAX products or offers) can be booked via the website, through the booking module.
The contract between the parties is only formed once SKYMAX has sent an e-mail confirmation of the customer's acceptance of the offer.
Any change to a confirmed order is subject to SKYMAX's written agreement, under the conditions set out in article 10.
In accordance with article VI.53 12° of the Code of Economic Law, leisure activity services, including leisure parks, are excluded from the right of withdrawal.

ARTICLE 10 - MODIFICATION OF BOOKINGS

10.1. Classic activities (excluding birthdays and groups)
  • Any request for modification (change of schedule, number of participants, etc.) must be sent by e-mail to the SKYMAX team no later than 24 hours before the scheduled session.

  • We will do our best to respond favorably, within the limits of availability. No invoicing is applied for this type of modification.

10.2. Birthday
  • Any change in the number of participants must be communicated by e-mail no later than 3 days in advance.

  • The minimum number billed is 8 children, even if fewer participants are present on the day.

  • The maximum number of participants is 26 children per birthday. Beyond 26 children, no extension is possible, unless prior written agreement has been obtained from SKYMAX.

10.3. Groups & events
  • Any major modification (date, schedule, number of participants) must be requested in writing no later than 5 working days before the event.

  • Any request is subject to validation according to our availability.

  • The number of participants confirmed by this deadline will be considered as the minimum basis for final invoicing.

Article 11 - Cancellation and refund

11.1. Standard activities (excluding birthdays and groups)
  • Reservations for standard activities (SKYJUMP, SKYMINI, ARCADE, HOLOGATE VR...) do not require advance payment. No charge will be made for late cancellations. However, please let us know as soon as possible to free up space for other visitors.

11.2. Birthday bookings
  • All birthday bookings require a flat-rate deposit of €50 on confirmation. In the event of cancellation up to 3 days before the scheduled date, the deposit is refunded in full. In the event of cancellation less than 3 days before the scheduled date, the deposit is retained.

11.3 Group bookings and events
  • Bookings for groups or private events (schools, companies, EVJF/EVG, etc.) of more than) of more than 20 people require payment of a deposit of 50% of the total amount on confirmation.
    In the event of cancellation up to 7 working days before the scheduled date, the deposit is refunded in full.
    In the event of cancellation less than 7 working days before the scheduled date, the deposit is retained.

11.4 Refunds
  • Any refunds will be made within 14 days of the originally scheduled date. Unless otherwise requested in writing, refunds will be made to the bank account used to pay the deposit.

Article 12 - SKYMAX warranties and liabilities

The description of the services offered is provided for information only and does not bind SKYMAX in the event of visitor dissatisfaction;
Our equipment, materials and facilities are checked and tested with the utmost care. However, it is the visitor's responsibility to report any anomalies he or she may notice.
Visitors use the equipment, facilities and amenities under their own responsibility and undertake not to damage or depreciate the equipment and facilities made available to them and will be liable to reimburse SKYMAX for any damage caused to the equipment or facilities made available to them;
SKYMAX and the staff members for whom it is responsible cannot be held liable for any material or immaterial damage (accident, injury, etc.) suffered by the visitor during the activity.) suffered by the visitor while at the Trampoline Park, unless the bodily injury was caused by a fault or gross negligence on the part of SKYMAX;
SKYMAX declines all responsibilitý for loss, theft, disappearance, damage or deterioration to the visitor's personal belongings while at SKYMAX.  The visitor is advised not to bring valuables. The supervision and custody of visitors' personal belongings is the sole responsibility of the visitor. 
Specific note SKYJUMP:  the visitor declares that he/she is aware that trampolining is an intense sporting discipline, is in good health and is fit to jump on our canvases. The visitor is fully aware and accepts that participation in trampoline activities involves health risks and may result in property damage as well as serious bodily injury. The visitor is responsible for his or her actions and must carry out the activitý in compliance with the elementary rules linked to the practice of trampolining, while taking into account his or her capacities (physical and mental);

Article 13 - complaints

In the event of complaints, the visitor is required to inform the manager of the SKYMAX establishment concerned immediately, or if this is not reasonably possible, no later than forty-eight (48) hours after leavinǵ the establishment concerned;
In accordance with the provisions of the Belgian Code of Economic Law, in the event of the occurrence of a dispute relating to the validitý, interpretation or performance hereof, the visitor may have recourse to the consumer mediation procedure, under the conditions provided for in the said Code.

Article 14 - Force majeure

SKYMAX shall not be bound by its obligations under the contract if it is prevented from doing so by a circumstance of force majeure for which it cannot be held responsible (strike, pandemic, administrative closure, major technical problem).
In the event of force majeure, only the reimbursement of unperformed services may be considered, without further compensation.

ARTICLE 15 - PERSONAL DATA PROTECTION

SKYMAX collects and processes the personal data of Clients and Visitors in accordance with current legislation, in particular Regulation (EU) 2016/679 (RGPD), and its Privacy Policy available at the following address: https://skymaxpark.com/en/privacy_policy/.
This Policy specifies the purposes of processing, the legal bases, the rights of individuals and the means of exercising them.
You have the right to access, rectify, erase, limit and object on legitimate grounds, as well as the right to portability of your data. These rights can be exercised by contacting: info@skymaxpark.com.
As part of the activities and events organized by SKYMAX, photos and/or videos may be taken for security (video surveillance) and marketing (website, social networks, promotional materials) purposes.
These shots are in principle general (non-targeted atmospheric photos).
Any targeted and identifiable shots will only be used with the explicit consent of the person concerned (or their legal representative for minors).
Visitors who do not wish to appear in photos or videos must inform reception before entering the park. This objection does not affect images from video surveillance, which meets a legal security obligation.

Article 15 - Intellectual property and respect for the website 

The website, its content and any other material and elements of the site whatsoever are protected by intellectual property rights (and in particular the provisions contained in the Belgian Code of Economic Law, as well as by all international texts in force) and remain the exclusive property of SKYMAX or the relevant rightful claimants.
In particular, it is forbidden, even if technically possible, to reproduce, download, modify, adapt, use, translate, distribute, communicate to the public, market or make available all or part of the content of the website, for any purpose and in any manner whatsoever, permanently or temporarily, whether for commercial or non-profit purposes;
The website and its content may not be used for any purpose other than those expressly authorized or required by navigation on the site. Any unauthorized use of the site's content may constitute an infringement of copyright or give rise to civil or criminal legal proceedings and the payment of damages;
The website, its content and its addresses are published by the limited company SKYMAX PARK, whose details are given in article 1. It is hosted by OVH and is accessible without guarantee;
The user and visitor, whoever he may be, uses the site under his own and sole responsibility.despite all the care taken in the construction of the site, SKYMAX cannot guarantee and cannot be held liable for any damage caused by, inter alia, an interruption, defect or error in the functionalities offered by the site or in the information provided, a delay in operations or transmissions or in general an interruption in the operation of the site, a computer virus or other similar technical problems, a network fault, or for any other reason whatsoever, when using the site or its content;
SKYMAX manages the content of the site freely and independently and may therefore, without prior notice to the visitor or user, suspend or cancel access to the site or any part of it, modify the information and products available on the site or modify the site's presentation, structure and sections;
The visitor undertakes not to commit or omit any act that would have the purpose or effect, directly or indirectly, of disrupting or interrupting the networks connected to the site or the servers of third parties, not to confuse with any regulations and procedures of the Internet network, interfere with the use of the Site, copy, alter, modify, interfere with the Site, its use or content, or use the Site for any purpose that is unlawful, prohibited by the terms of the TOS, or infringes the rights of SKYMAX, or encourage any such acts;
The visitor will not interfere with the use of the site by third parties, for example by attempting to obtain access to personal data, passwords or to trace any information on third parties who have accessed the site;
The visitor will not test the site's capacity or vulnerability and will refrain from any act that could undermine its security or integrity. He also undertakes not to perform any act that has the effect of imposing a bandwidth overload;
The visitor undertakes to indemnify SKYMAX in the event of any action, loss, claim, compensation, indemnification (including attorneys' fees), brought against SKYMAX by any third party, in connection with or as a result of inappropriate use of the site.

Article 16 - Invalidity of a clause

If one or more clauses of these GTC should be considered invalid for any reason whatsoever, only the minimum will be considered invalid and will be replaced by valid provisions that best respect the purpose of the GTC. The remaining provisions shall remain in full force and effect.

Article 17 - Applicable law and competent jurisdiction

These GTS, the use of the website and the entire relationship between SKYMAX and the visitor are governed entirely by Belgian law. 
Any disputes shall be submitted to the courts of the district of Brussels.
